New legislative decree on energy cost containment approved

On 18 February 2022, the Council of Ministers approved a new decree-law that introduces emergency measures to reduce energy costs in the short term, as well as forward-looking measures to increase national production, develop renewable energy and relaunch industrial policies.

As regards the emergency measures is laid down:

  • Extension to the second quarter of 2022 of the measures already in place, such as the zeroing of rates on general system charges applied to domestic users and non-domestic users in low voltage, for other uses, with available power up to 16.5 kW, as well as users with available power equal to or greater than 16.5 kW, including those connected in medium and high/very high voltage or for public lighting or electric vehicle recharging in places accessible to the public;
  • Reductionof VAT to 5% and of general charges for the gas sector;
  • Contribution in the form of a tax credit for energy-intensive enterprises and new extraordinary contribution in the form of a tax credit for gas-intensive enterprises.

On the forward-looking measures procedures for the long-term supply of natural gas at fair prices defined by the MEF/MITE/ARERA are envisaged, and there is also an acceleration on the renewables front, in particular for the supply of photovoltaics, with simplification measures for installation on the roofs of public and private buildings and in agricultural and industrial areas.

We are waiting for the publication in the Official Journal and for the implementation measures that will have to specify the modalities of application.
