"Energy Release" opportunities MiTE Decree No. 341 of September 16, 2022

The Energy Release Decree MiTE is a mechanism for enterprises to price electricity by allocated volumes through a pro-rata with a three-year contract with the GSE.

The reference price is set at 210 €/MWh, but there is a possibility that this price may be changed either up or down over time.

The maximum volume is 1.6 TWh and the minimum volume is 3.34 GWh (consumption considered is the annual average of grid withdrawals over the past 3 years). Entities with higher withdrawals (also aggregators) are favored for sharing the remainder.

Energy Release established by the MiTE Decree: who can participate

End customers, including through aggregators, who possess at least one of the following characteristics can participate in the Energy Release Decree MiTE:

1. industrial end customers whose utilities refer to local units operating in the sectors of economic activity subject to calculation of industrial production by the National Institute of Statistics (ISTAT);
2. small and medium-sized enterprises as defined in European Commission Recommendation No. 2003/361/EC of May 6, 2003;
3. end customers located in Sicily and Sardinia and participating in Terna's electricity interruptibility service;
4. Energivorous end customers referred to in the Decree of the Minister of Economic Development December 21, 2017;

An allocation between 7 percent and 26 percent is assumed.

As a result of the procedure, the GSE enters into a contract with each allottee for difference sale until December 31, 2025.

This will be a financial contract between the GSE and the successful bidder: the GSE pays or receives the difference between the allocation price and the average monthly PUN price of electricity.

In contrast to the Energy Release of the MITE Decree, the regulation published by the GSE provides for data collection of withdrawals only, excluding self-consumption.
